1. Introduction & Acceptance
Welcome to Sama Rides ("we", "our", or "us"). Sama Rides operates a mobile application and digital platform that connects passengers seeking transport with independent taxi drivers and riders. By downloading, installing, or using our app, you agree to comply with and be bound by these Privacy Policy and Terms of Service.
2. Age Restrictions & Legal Capacity
You must be at least 18 years of age to register, create an account, purchase SMS credits, or use the Sama Rides platform. By using the app, you represent that you meet this age requirement and possess the legal capacity to enter into a binding agreement.
3. Privacy Policy & Data Collection
We respect your privacy and limit data collection strictly to what is necessary for core system functionality. We do not use personal data for any unrelated commercial purposes.
Information Collected
- Passenger Data: Name, phone number, and destination details entered when searching for a ride. Passengers are not charged for search or dispatch actions.
- Driver Registration Data: Drivers must register by uploading verification documents including a valid driving license, vehicle inspection report, certificate of good conduct, passport-style photo, vehicle insurance, and any other required compliance documents. Drivers must also input a correct phone number for receiving SMS ride requests.
- Location Data:
- Drivers must keep location services turned ON while active so nearby passengers within a 2km radius can view them on the app.
- Passenger location and destination inputs are used exclusively for search proximity matching and routing.
- Financial & Payment Data: Sama Rides does not handle trip fare cash transactions. Instead, drivers purchase SMS credits via M-Pesa STK push within the app to maintain communication and receive ride requests.
Data Sharing & Account Deletion
Your phone number and name are shared with matched counterparts only for the duration required to arrange a trip. We do not sell or rent personal information to third parties.
Both drivers and passengers have the right to request account and data deletion by sending an email to admin@masomo.website.
4. Terms and Conditions
- Intermediary Role: Sama Rides acts strictly as a technology platform connecting independent drivers and passengers. We are not a transportation carrier. Fares are settled directly between passenger and driver.
- SMS Token & Dispatch Model: Drivers must maintain sufficient SMS credit balances purchased via M-Pesa STK push to receive and respond to incoming passenger requests. Drivers view live requests on their dashboard and can accept or reject them. Passengers can track whether a driver accepts or rejects a request.
- User Conduct & Requirements: Users must provide accurate details. Drivers must install the app on a smartphone and comply with vehicle and documentation standards. Misuse, fraudulent bookings, or policy violations will result in account suspension.
5. Limitation of Liability
The Sama Rides platform is provided on an "AS-IS" and "AS-AVAILABLE" basis. We disclaim liability for any direct, indirect, or incidental damages, accidents, physical injuries, or disputes arising from rides coordinated through the platform.
